CPAP Store Dallas offers both genuine manufacturer products and aftermarket-compatible products. Aftermarket products are clearly identified and are not affiliated with, endorsed by, or sponsored by the original manufacturer.

 

Where CPAP Store Dallas is an authorized dealer for a specific brand or product, such authorization is explicitly disclosed. Authorization for one brand does not extend to all brands or products.

 

4.C Independent Resale & Product Sourcing

 

CPAP Store Dallas operates as an independent retailer engaged in the lawful resale of genuine products through its retail and e-commerce channels.

 

All branded products offered for sale, including but not limited to ResMed®, are genuine goods lawfully acquired through legitimate and commercially recognized channels.

 

All products sold as “new” are offered in their original, unused condition and are not materially altered, except where expressly disclosed.

 

CPAP Store Dallas accurately represents product condition and maintains commercially reasonable practices to ensure that customers receive genuine products as described.

 

Nothing in these Terms shall be interpreted as requiring CPAP Store Dallas to obtain authorization from any manufacturer in order to resell genuine goods.

 

4.D No Material Differences; Product Condition Disclosure

 

To the best of CPAP Store Dallas’s knowledge, products sold as “new” are not materially altered in any manner that would affect their intended performance, safety, or use.

 

Any differences between products sold by CPAP Store Dallas and those distributed through manufacturer-authorized channels are commercially incidental, including but not limited to warranty coverage, service arrangements, or distribution pathways, and do not affect core functionality.

 

Customers acknowledge that such differences do not constitute a defect or misrepresentation.

 

4.E Supplier Confidentiality & Non-Interference

 

CPAP Store Dallas sources products through lawful and commercially recognized channels. Supplier identities and sourcing relationships constitute confidential and proprietary business information.

 

CPAP Store Dallas is under no obligation to disclose such sourcing information to any third party except as required by applicable law.

 

CPAP Store Dallas operates independently and does not interfere with, induce breach of, or participate in any contractual relationships between manufacturers and their authorized distributors or dealers.

 

All products are acquired without inducement of any contractual violation.

 

5. Communications and User Submissions

 

By communicating with us electronically, you consent to receive communications electronically, including legally required notices.

 

If you submit reviews, comments, or other content, you grant CPAP Store Dallas a perpetual, royalty-free, worldwide license to use, reproduce, and publish such content.

Manufacturer warranties, if any, are provided solely by the original manufacturer and may not apply to products purchased from independent resellers. CPAP Store Dallas does not adopt, extend, or represent any manufacturer warranty unless expressly stated in writing.

 

Any warranty, support, replacement, or service provided by CPAP Store Dallas is independent of the manufacturer and may be fulfilled through independent and qualified third-party service providers, and is provided at CPAP Store Dallas’s sole discretion.

 

No oral or written information or advice shall create any warranty not expressly stated in these Terms.

 

Customers acknowledge that differences between independent retailers and manufacturer-authorized sellers do not constitute defects or misrepresentation.

 

11. Indemnification

 

You agree to indemnify and hold harmless CPAP Store Dallas and its affiliates from any claims arising from your use of the Site or violation of these Terms.

 

12. Dispute Resolution & Governing Law

 

These Terms shall be governed by the laws of the State of Nevada.

 

Any dispute shall be brought exclusively in the state or federal courts located in Clark County, Nevada. You waive any right to a jury trial and agree to bring claims individually.
